Terms & Conditions:

1. The buyer shall not hold the City of Oshkosh, including but not limited to its officials (elected or appointed), directors, officers, employees, agents, insurers, successors and assigns, or any other person or business working for the city, liable for any damages or injury that may be caused to any individual for any item purchased by the buyer at the sale site, be it equipment, fixtures or any other item irrespective of size, kind condition or any other factor.
2. The buyer shall assume all responsibility for items purchased irrespective of when they are removed from the time they are declared to be the buyer by the city and from that time forward, and the city shall have no further responsibility or liability whatsoever including insurance, bailment and other similar possessory type responsibilities, for such items from the time of that declaration.
3. It is understood that no claims for shortages or adjustments shall be made, that all items are sold and delivered to the buyer “as is”, that there are no warranties or guarantees, either expressed or implied, and that the buyer, by his/her act of paying for such item(s), expressly releases the city of all liability for its prior use of the item(s) [see paragraph one above.]
4. If for any reason items are purchased and not removed within 10 business days of award notification, the city shall dispose of the item(s) by any method, in its sole discretion, the city deems expedient.
5. Terms: Cash, money order or certified check including sales tax payable to the City of Oshkosh shall be received by the city prior to releasing the auction item(s).  The  Purchasing Division will complete a bill of sale and a copy given to the successful buyer.
6. All payments are to be made to the Collections Department on the 1st floor of City Hall - 215 Church Avenue.  After payment buyers may claim their purchased goods from the Purchasing Division on the 4th Floor, Room 401 of City Hall.
